Webs by Platinium is a SaaS platform that enables small and medium-sized businesses to create, publish and manage websites using artificial intelligence. The service includes:

• Automatic generation of personalised websites using AI
• Publication under subdomain at websbyplatinium.net
• Website editor with artificial intelligence assistant
• Online bookings and appointments management
• Optional integration with conversational AI agent (Plus and Pro plans)
• Business management dashboard

3. Plans and pricing

Prices are shown in euros (€) and include applicable VAT/taxes where relevant. Platinium Labs LLC reserves the right to modify prices with 30 days' notice.

4. Registration and account

• To access the service you must register with a valid email address.
• You are responsible for maintaining the confidentiality of your access and all activities carried out from your account.
• You must notify us immediately of any unauthorised use of your account.
• Only one active account per email address is permitted.
• You must be over 18 or acting on behalf of a legally constituted business.

5. Payments and billing

• Payments are processed securely through Stripe, Inc. Platinium Labs LLC does not store bank card details.
• The subscription renews automatically each month on the date of purchase.
• You can cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period.
• We do not issue refunds for partial periods, unless required by law or due to an error attributable to Platinium Labs LLC.
• In the event of non-payment, access to the service may be suspended until the situation is resolved.

6. Acceptable use

By using the service, you agree not to:

• Publish illegal, defamatory, obscene, fraudulent content or content that infringes third-party rights.
• Attempt to access unauthorised areas of the system or other users' accounts.
• Use the service to send spam, malware or any harmful content.
• Reverse engineer, decompile or disassemble any part of the software.
• Use the service in a way that may damage, overload or deteriorate its operation.
• Resell or sublicense access to the service without express authorisation.

Violation of these rules may result in immediate suspension or cancellation of your account.

7. Intellectual property

7.1 Platinium Labs LLC content

The platform, including its code, design, brand and technology, is the exclusive property of Platinium Labs LLC and is protected by applicable intellectual property laws. No licence is granted over these elements except the limited right to use the service under these terms.

7.2 User content

You retain all rights over the content you enter into the platform. You grant us a limited, non-exclusive licence to use such content solely for the purpose of providing the service.

7.3 Generated websites

The websites generated by our AI from your information are yours. However, Platinium Labs LLC reserves the right to use anonymised examples to improve the service.

8. Affiliate programme

• The standard commission is 30% of the net price of the plan contracted by the referred user.
• Commissions are paid on the 1st of each month, with a minimum of €50 accumulated.
• Platinium Labs LLC reserves the right to suspend or modify the programme with 30 days' notice.
• Self-referral, fraud or any manipulation of the tracking system is prohibited.
• Commissions generated fraudulently will be voided and may result in account closure.

9. Availability and service level

We strive to keep the service available 24/7, but we do not guarantee uninterrupted availability. We may carry out scheduled maintenance with prior notice. We will not be liable for interruptions caused by third parties or force majeure.

10. Limitation of liability

To the maximum extent permitted by applicable law, Platinium Labs LLC will not be liable for:

• Indirect, incidental, special or consequential damages arising from the use or inability to use the service.
• Loss of data, revenue or profits.
• AI-generated content, which may contain inaccuracies and must be reviewed by the user before publication.
• Actions of third-party providers (Stripe, Supabase, etc.).

11. Cancellation and termination

• By you: you can cancel your subscription at any time from the dashboard. The service will remain active until the end of the paid period.
• By us: we may suspend or cancel your account with prior notice in case of breach, non-payment or fraudulent use. In serious cases, cancellation may be immediate.
• After cancellation, your published website will remain active for an additional 30 days so you can make a copy, after which it will be deleted.:

12. Governing law and jurisdiction

These terms are governed by the laws of the State of Wyoming, USA. For users residing in the European Union, the mandatory rules of your country of residence will prevail where they are more favourable to you as a consumer.

Disputes that cannot be resolved amicably will be submitted to the competent courts of the State of Wyoming, without prejudice to the rights you may exercise as a European consumer before the courts of your country or through the EU Online Dispute Resolution platform. ec.europa.eu/consumers/odr

13. Modifications

We may update these terms occasionally. Material changes will be notified by email with at least 30 days' notice. Continued use of the service implies acceptance of the new terms.
